Against Medical Advice

The discharge of a patient against medical advice (AMA) represents a medical-legal risk. In general, the patient leaving AMA is in need of additional emergency medical care or hospital admission. Because treatment is incomplete, this patient group is at increased risk for medical complications, including disability or death. In this activity, we examine the rights of patients to refuse treatment and leave AMA, and we review steps that medical staff can take to protect against exposure to liability. We present and discuss real cases to illustrate key points. After completing this activity, practitioners should be able to: assess patient safety through careful evaluation of the reason for the AMA decision; determine when a patient does or does not have the right to sign out AMA; and properly document the patient s AMA decision and create an AMA note that provides protection from lawsuits or allegations of wrongdoing.
