It has long been the law that a competent adult has the right to consent or refuse to consent to any form of medical treatment. It is also the case that someone has the right to consent or refuse to consent to medical treatment for a minor child, but this is more complicated than in the case of an adult. While this normally requires parental consent, the solution to the problem is not that simple. There may not be a parent in the picture, the parent may also be a minor, parents may be unavailable when the child needs care, the minor may not want the parents to be involved, or the parents may not be acting in the child’s best interests.
This course will deal with various issues surrounding consent for treatment for a minor with the understanding that there may not be a uniform rule applicable in all states and under all circumstances. In this activity, we provide a brief overview of state law from randomly selected states as well as case reviews on the following topics: non-parental consent; consent for non-emergency lifesaving care; parents’ refusal of lifesaving emergency care; and emancipated minors. After completing this activity, practitioners should be able to: interpret their responsibilities when asked to care for a minor without parental consent; appraise the options to provide necessary treatment to a minor despite the parents’ refusal to consent; and judge what emancipation is and the effect that it has on consent for the treatment of a minor.
